What is divorce mediation? Divorce mediation is an alternative dispute resolution method; it takes the entire litigation process of court and it’s removed so the parties essentially take control of their divorce. They take control of the decision making process. It’s a neutral environment with a facilitator, a mediator essentially, who sits down with the parties and that mediator helps the parties facilitate discussions about their issues. What are the issues at hand? Are they custody, are they child support, are they alimony, are they distribution of assets? What is before this particular family that needs to be decided? The good news is that the issues get decided by the parties, they’re in control. They make compromises; they determine what their final settlement terms will ultimately be. And they don’t put those decisions in the hand of a judge who knows very little about this particular family. And the good news about this, also a tremendous benefit, is it’s a cost saver and the parties are in control of their ultimate destiny.
